Magic mushroom delivery and online orders in Las Vegas: the law and the risks
No. Nobody can legally deliver or mail psilocybin mushrooms to anyone in Las Vegas: transporting or selling them is a felony in Nevada, and distributing them is a federal drug crime. No state allows psilocybin to be sold by mail, Oregon and Colorado included.

Is magic mushroom delivery legal in Las Vegas?
No. Nevada makes it a felony to import, transport, sell, supply or give away a Schedule I drug such as psilocybin, or to offer to (NRS 453.321).13 Federal law makes distributing it a crime punishable by up to 20 years in prison (21 U.S.C. 841), and whoever receives the package possesses a Schedule I drug under both Nevada and federal law.416
The team that publishes this site runs its own shop, mymushroomdispensary.com, which ships to Nevada. The laws on this page apply to those orders the same way they apply to any other seller's.
Which laws does a mushroom delivery break?
Nevada defines "delivery" as "the actual, constructive or attempted transfer from one person to another of a controlled substance" (NRS 453.051).1 NRS 453.321 makes it unlawful to import, transport, sell, exchange, supply or give away a controlled substance, or to offer or attempt to. For a Schedule I drug, a first offense is a category C felony, punished by 1 to 5 years in prison; a second offense is a category B felony with 2 to 10 years.12
The person who receives the package isn't in the clear. Possession is covered by NRS 453.336, which starts at a category E felony for a first or second offense under 14 grams, where the court must defer judgment if the person consents, and rises with weight. At 100 grams or more of any "mixture which contains" a Schedule I drug, the trafficking statute (NRS 453.3385) applies.1
Federal law applies in every state. Distributing a Schedule I drug carries up to 20 years (21 U.S.C. 841(b)(1)(C)).4 Using "any communication facility," which the statute defines to include "mail, telephone, wire, radio, and all other means of communication," to commit or facilitate a federal drug felony is a separate crime, with up to 4 years for each use (21 U.S.C. 843(b) and (d)).5 Simple possession is a federal crime as well (21 U.S.C. 844).6
The full penalty table is on our Nevada psilocybin law page. This describes the statutes, not legal advice; anyone facing a charge should talk to a Nevada criminal defense lawyer.
Can you order from Oregon or Colorado, where it's legal?
No. Neither state's licensed program sells psilocybin by mail. In Oregon, psilocybin products can be bought only at a licensed service center during an administration session, and they can't be bought and taken off-site.8 In Colorado, the new limited sales license created in 2026 can't be used to sell for use anywhere except the co-located healing center's licensed premises (Rule 8006).9 Carrying psilocybin from either state into Nevada is illegal transport under NRS 453.321.1
The nearest licensed option is a Colorado healing center in Durango, 537 miles from the Strip by road.10 Oregon's licensed service centers are farther. Our page on legal psilocybin near Las Vegas has the distances and the rules for visitors.
What's actually in a mail-order "mushroom" package?
No one outside the sale can say. No state licenses or inspects anyone who sells psilocybin by mail, because no state allows it.89 Testing reported by FDA and in CDC's MMWR shows how far labels can drift from contents:
- After an outbreak linked to 180 illnesses in 34 states, FDA tested 22 chocolate bars, 10 cones and 22 gummies from Diamond Shruumz, a brand sold online and in stores. It found muscimol, acetylpsilocin (4-AcO-DMT, a close chemical relative of psilocin), psilocin, the prescription drug pregabalin and kava compounds, in mixes that varied even within one flavor.11
- Six of those 22 gummies tested negative for every compound in FDA's results table.11
- In Virginia, investigators bought six packages of "mushroom" gummies from five brands; four held psilocybin or psilocin that wasn't on the label, and the tests also found other unlabeled substances, including caffeine, ephedrine and kratom.12
Fentanyl. None of the product testing cited on this page found fentanyl in mushroom products. It is a risk in the wider illegal drug supply: opioids were involved in 60.1% of the 549 drug overdose deaths among Clark County residents in 2022, according to the Southern Nevada Health District.13 Nevada made it a separate felony in 2023 to sell a mixture of fentanyl and another controlled substance while knowing it contains fentanyl and intentionally not telling the buyer (NRS 453.3355).1 SNHD said in 2023 that nasal naloxone and fentanyl test strips are available to the public at the SNHD Decatur Pharmacy.13 A test strip checks for fentanyl; it can't tell you what else something contains.
Scams and fakes. With no licensed seller anywhere, there's no regulator to complain to if a package never arrives or holds something else. Nevada treats fakes as their own crime: selling a substance "represented to be a controlled substance" is unlawful, and using or possessing one with intent to use it is a gross misdemeanor on a first or second conviction (NRS 453.332).1
What can a seller's lab report (COA) tell you?
A certificate of analysis (COA) is a lab's report on a sample from one batch. It can show what that lab found in that sample, for the compounds it tested. It can't show three things:
- What wasn't on the test list. The Virginia investigators' instrument couldn't test for muscimol, ibotenic acid or muscarine, so their report can't say whether the Amanita compounds printed on those labels were present.12
- That your package matches the sample. FDA found different compounds in different samples of the same Diamond Shruumz flavor.11 A report covers only the sample it describes.
- That the product is legal. A COA that shows psilocybin is a record that the product contains a Schedule I drug.3
Does a 21+ age check make an order legal?
No. An age gate or ID check is a seller's policy, not a license, and neither Nevada's nor the federal possession statute makes an exception for adults.16 Age limits do exist in the legal programs, alongside supervised, on-site use: Oregon's clients must be 21 or older, and Colorado's healing centers must verify that participants are 21 or older (Rule 8015).89
Federal law adds weight on the seller's side: a person 18 or older who distributes a controlled substance to someone under 21 faces twice the maximum punishment for a first offense, with at least one year in prison (21 U.S.C. 859).7 In Nevada, a second or later conviction for selling a controlled substance to a minor is a category A felony (NRS 453.334).1
What to do if someone feels sick after taking something
Call 911 for a seizure, chest pain, trouble breathing, overheating, or anyone who can't be woken. For questions about a product someone ate, call Poison Control at 1-800-222-1222, which connects Nevada callers to the Nevada Poison Center.14 For a frightening experience that isn't a medical emergency, the Fireside Project's peer support line takes calls and texts at 62-FIRESIDE (623-473-7433), every day from 11 a.m. to 11 p.m. Pacific.15 Tell responders what was taken and keep the packaging. Questions people ask
Is it legal to buy magic mushrooms online in Nevada?
No. Psilocybin is a Schedule I drug under Nevada and federal law, so buying it online means possessing a Schedule I drug, and the seller is distributing one. No state, including Oregon and Colorado, allows psilocybin to be sold by mail.
Are "legal" mushroom gummies sold online any different?
They're sold as something other than psilocybin, but their labels can't be relied on. Amanita muscaria isn't a scheduled drug, but FDA says it isn't allowed in food, and gummies labeled as Amanita have tested positive for psilocybin and psilocin that weren't on the label.
What should I do if I'm charged with possession in Nevada?
Talk to a Nevada criminal defense lawyer. For a first or second offense under 14 grams, NRS 453.336 requires the court to defer judgment if the person consents, but outcomes depend on the facts of each case.
