Microdosing in Las Vegas: the law and what the research shows
No. Nevada has no exception for small amounts, so a psilocybin microdose is possession of a Schedule I drug like any other. In placebo-controlled trials, people who microdosed mostly did no better than people on placebo, though researchers disagree on whether the question is settled.

Is microdosing legal in Las Vegas?
No. Psilocybin is a Schedule I drug in Nevada, and the state's possession law has no exception for small amounts: knowingly possessing any amount without a prescription is a crime31. For a first or second offense involving less than 14 grams, it's a category E felony, and the court must defer judgment if the person consents1.
The team that publishes this site also runs an online shop, and the microdosing guide from My Mushroom Dispensary is that shop's own guide. This page covers what Nevada law says, what controlled studies found and who should steer clear, not amounts or schedules.
Does Nevada treat a microdose differently?
No. NRS 453.336 says a person "shall not knowingly or intentionally possess a controlled substance" unless it came from a prescription or another use the chapter authorizes1. The penalty tiers are set by quantity, and the lowest tier simply covers everything below the first threshold. Nothing in the statute turns on the word "microdose", on the product's form (capsule, gummy, chocolate or dried mushroom) or on why someone has it.
- First or second offense, Schedule I, less than 14 grams: a category E felony. The statute says "the court shall defer judgment upon the consent of the person"1.
- What a category E felony carries: NRS 193.130 sets a prison term of 1 to 4 years and requires the court to suspend the sentence and grant probation, which can include up to a year in county jail, except in listed cases. First and second offenses in the lowest possession tier are one of those listed exceptions; for them, the possession statute's own deferred-judgment rule applies21.
- Third or later offense, less than 14 grams: a category D felony1. Larger amounts fall into higher tiers, set out on our Nevada psilocybin law page.
- Sharing: NRS 453.321 lists giving away a controlled substance alongside selling it; for a Schedule I drug a first offense is a category C felony1.
Psilocybin is also Schedule I under federal law4, and buying it online or by mail doesn't make it legal in Nevada or anywhere else14; our page on delivery and online orders explains why. This is a summary of the statutes, not legal advice. If you're facing a charge, talk to a Nevada criminal defense lawyer.
What placebo-controlled trials found
Many people who microdose report better mood, focus and creativity, but anecdotal reports can't separate the drug from the expectation5. Placebo-controlled studies can. Here are four, checked on PubMed. Three used psilocybin, psilocybin mushrooms or truffles; in the largest, most participants used LSD:
| Study | Design | What it found |
|---|---|---|
| Szigeti and colleagues, eLife, 2021 | "Self-blinding" citizen science: 191 people who microdosed with their own psychedelics (mostly LSD or LSD analogues; about a quarter used psilocybin mushrooms) set up their own placebo control from online instructions, over a 4-week period | Both groups improved on the psychological measures, with no significant difference between microdose and placebo. Small short-term differences could be explained by people guessing what they'd taken5 |
| Cavanna and colleagues, Translational Psychiatry, 2022 | Double-blind and placebo-controlled; 34 people starting to microdose with psilocybin mushrooms | Effects felt stronger than placebo only among people who correctly guessed their condition. EEG showed changes in brain rhythms, but there was no evidence of better well-being, creativity or thinking, and a few small changes pointed toward impairment6 |
| Marschall and colleagues, Journal of Psychopharmacology, 2022 | Preregistered, double-blind, placebo-controlled crossover with psilocybin | No effect on emotion processing or on anxiety and depression symptoms compared with placebo; participants broke the blind in the study's second block7 |
| Prochazkova and colleagues, Neuropharmacology, 2026 | Two randomized, double-blind, placebo-controlled trials with psilocybin truffles | No significant effect on behavior or self-reported measures compared with placebo; unpleasant bodily feelings were stronger on the active condition; participants stayed blinded8 |
The 2021 study's authors wrote that their findings suggest the anecdotal benefits "can be explained by the placebo effect"5. The 2022 mushroom study found effects "without evidence to support enhanced well-being, creativity and cognitive function" and concluded that expectation "underlies at least some" of the reported benefits6.
Not everyone reads the evidence as closed. A 2024 review of 19 placebo-controlled microdosing studies of LSD and psilocybin found some measurable changes compared with placebo and argued that calling microdosing mostly placebo is premature: there have been few studies, they've been small, they've tested only a handful of doses and they've looked only at people without a diagnosed condition. Its conclusion: "it is not yet possible to determine whether microdosing is a placebo." Both of its authors disclosed research funding from psychedelic drug developers9.
So the fair summary is narrow. Controlled studies so far haven't shown that microdosing psilocybin reliably improves mood, focus or creativity beyond what expectation does, and as of that 2024 review, no placebo-controlled study had tested people with a diagnosed condition9.
What about "microdose" products sold in shops?
A label isn't a lab result. In 2024 the FDA investigated illnesses linked to Diamond Shruumz products, including chocolate bars sold as "Microdosing Chocolate Bars", which were sold online and in smoke and vape shops. By the final count there were 180 illnesses in 34 states, 73 hospitalizations and 3 potentially associated deaths; Nevada had 2 of the cases. FDA testing found muscimol, acetylpsilocin (4-AcO-DMT), psilocin, the prescription drug pregabalin and kava compounds in various products, and the products were recalled10.

Who should avoid psilocybin?
Oregon's regulated program says a client may be found ineligible if they're having thoughts of harming themselves or others, have taken lithium within the past 30 days, or have ever been diagnosed with active psychosis11.
Clinical trials screen out more. The VA's PIVOT psilocybin trial, for example, excludes people with:
- bipolar disorder, a schizophrenia-spectrum disorder or another psychotic disorder at any point in their life;
- a parent, sibling or child with bipolar I disorder, a schizophrenia-spectrum disorder or another psychotic disorder;
- pregnancy or breastfeeding;
- a history of heart attack, heart failure, stroke or severe heart disease;
- recent use of medications on the trial's prohibited list12.
If you take any psychiatric medication, including lithium or an antidepressant, talk to the prescriber, and don't stop a medicine on your own. In Las Vegas, heat is a separate risk worth counting: Clark County recorded 284 heat-associated deaths in 2025, according to the Southern Nevada Health District13.

Questions people ask
Does Nevada have a small-amount exception for psilocybin?
No. NRS 453.336 makes knowingly possessing any amount of a controlled substance without a prescription a crime. The quantity only changes which penalty tier applies.
Are "microdose" capsules or gummies from a smoke shop legal?
If they contain psilocybin or psilocin, no: both are Schedule I in Nevada. Some products sold as microdosing candy have also turned out to contain other drugs entirely, as the FDA's 2024 Diamond Shruumz investigation showed.
Can a Las Vegas doctor prescribe psilocybin for microdosing?
No. There's no FDA-approved psilocybin medicine and psilocybin is Schedule I, so the only legal way to receive it in Nevada is in a clinical trial. Our psilocybin therapy page lists the trials with Las Vegas sites.
Is microdosing legal in Oregon or Colorado?
Not in the sense of buying it to take home. Oregon allows psilocybin only during a supervised session at a licensed service center, and Colorado's healing centers can't let participants leave with it. Colorado's separate personal-use law lets adults 21 and over possess it, but no one may sell it outside the licensed system, and federal law still applies. Bringing any back into Nevada is illegal transport.
