New Mexico holds a hearing on its medical psilocybin patient rule

New Mexico's health department took public comment on October 2, 2026 on 7.35.3 NMAC, the rule that will govern patients, clinicians and healing centers in its medical psilocybin program. The department aims to enroll its first patients by the end of 2026, the law's deadline is December 31, 2027, and as of November 2 we found no sign the rule had been adopted.

What was on the table

The New Mexico Department of Health held its public hearing on proposed rule 7.35.3 NMAC at 9 a.m. on October 2, 2026, in the Harold Runnels Building auditorium in Santa Fe, with video and phone access. Written comments were due by the close of the hearing.1

The rule sets standards for patient enrollment and for the certifying clinicians, practitioners, facilitators, healing centers, other approved locations and education programs in the state's Medical Psilocybin Program, including adverse health event reporting.1 The same hearing covered amendments to the producer and laboratory rule, 7.35.2 NMAC, on definitions, producer requirements and transportation.1

Under the proposed text, a patient and the patient's certifying clinician apply together. The patient supplies a name, address, date of birth and "a legible copy of the patient's driver's license or comparable photo identification card", and enrollment would last two years.2 Minutes of the advisory board's September 11 meeting record that denials were expected only for incomplete or fraudulent applications and that a passport or tribal ID would count as photo ID. The board voted 5 to 1 to move the rule forward. The department also told the board that producer applications had opened, several had been received and site visits were under way.6

Is the rule final?

Not that we can confirm. On November 2, 2026, the department's rulemaking page still listed 7.35.3 under pending rulemakings, alongside a final exhibit binder with all public comments.7 The posted draft shows its effective date as "xx/xx".2 We found no notice of adoption or effective date.

2026 or 2027: which deadline is real

Both dates are real, and they mean different things. The Medical Psilocybin Act, Senate Bill 219 of 2025, says in Section 7(C) that the department shall, "by December 31, 2027, implement the program."3 That's the legal deadline. The department's program page says the program "is set to be implemented by December 31, 2026", and its FAQ gives a goal of "enrolling the first patients by the end of December 2026".45 That's the department's own target. The FAQ also says enrollment hasn't started and that psilocybin "is not legally available in New Mexico outside of clinical research."5

The act took effect June 20, 2025.4 Its qualifying conditions are major treatment-resistant depression, posttraumatic stress disorder, substance use disorders and end-of-life care, plus others the department approves, and it covers natural psilocybin only, not synthetic versions.35

What it means if you're in Nevada

New Mexico could become a third legal option for Nevadans after Oregon and Colorado if its rules let out-of-state patients enroll, and Albuquerque is about 572 miles by road from the Strip.9 But it's a medical program, not a walk-in service. A patient needs a qualifying diagnosis and a certifying clinician who is licensed in New Mexico and holds a department permit.3

SB 219's definition of a qualified patient doesn't mention residency, and the proposed patient rule asks for a driver's license "or comparable photo identification" without saying it must be from New Mexico.32 That isn't settled: the rule isn't final, and the separate equity fund that would help pay for treatment is proposed for "qualified New Mexico patients".8

Nothing from the program could come back here. SB 219 removes psilocybin from New Mexico's drug schedule only for qualified medical treatment, and psilocybin remains a Schedule I drug in Nevada.310 See legal psilocybin nearest Las Vegas, psilocybin therapy and trials and when psilocybin could be legal in Nevada.

What happens next

  • November 20, 2026, 9 a.m.: hearing on 7.35.4 NMAC, the Medical Psilocybin Treatment Equity Fund, and on an amendment to the program's definitions, at the Harold Runnels Building and online.8
  • Adoption of 7.35.3 and an effective date. The department's target is first patients by the end of December 2026.5
  • If that target slips, the legal deadline is December 31, 2027.3
